These terms apply to the guest services provided at Finca Álamo. They set out what the PROVIDER supplies, what the GUEST agrees to, and how the stay is arranged.
The services under this agreement are provided by FINCA ÁLAMO DE CASARES, S.L., a Spanish company with registered office at Carretera de Casares, Km. 7, 29690 Casares (Málaga, Spain), tax identification number B93077576, entered in the Andalusian Tourism Registry under number VFT/MA/26913.
In these terms, FINCA ÁLAMO DE CASARES, S.L. is the PROVIDER and the person or organisation booking the stay is the GUEST. The PROVIDER is represented by [AUTHORISED REPRESENTATIVE].
This agreement is for the provision of accommodation and guest services at Finca Álamo de Casares. It is not a lease or a letting. It gives the GUEST no tenancy, no possession of the property and no other right over it.
The PROVIDER runs Finca Álamo as an accommodation business and keeps management of, and access to, the property throughout the stay. The GUEST receives the use of the accommodation for the agreed dates, together with the services set out below.
The price is a single inclusive charge for the accommodation and for the following services, which the PROVIDER supplies as part of running the property: preparing and setting up all accommodation areas for the agreed number of guests; bed linen and towels; final cleaning at the end of the stay; use and upkeep of the pool, sunbeds, gardens and outdoor areas; water and electricity for normal use; wireless internet; one drinking water container on arrival; waste collection; maintenance and technical support during the stay; and the assistance of the on-site host.
The following are available during the stay and are arranged through the on-site host: breakfast and catering; extra cleaning; additional towels and bed linen; bed preparation; food and supplies; drinking water containers; gas for the barbecue and industrial kitchen; use of the conference facilities; and airport transfers.
These are charged at the rates in the current price list, which forms part of this agreement, and are invoiced at the end of the stay.
A host is assigned to every stay. The PROVIDER gives the GUEST the host's name and contact details before arrival. The host welcomes the GUEST, hands over access, is available throughout the stay for requests, additional services and any problem with the accommodation, and attends the check-out.
These terms apply unless the PROVIDER and the GUEST have agreed otherwise in writing. Where these terms refer to the provider or the owner of the property, they mean the PROVIDER as defined in clause 1.
Cancellations must be made in writing. The following applies regardless of any change in the size of the group:
• Cancellation more than 90 days before arrival: 40% of the agreed total price is payable.
• Cancellation between 90 and 60 days before arrival: 60% of the agreed total price is payable.
• Cancellation less than 60 days before arrival: 100% of the agreed total price is payable.
The PROVIDER must receive from the GUEST, at least 14 days before arrival, everything needed to deliver the stay and the agreed services — including the final number of guests and any additional services required.
The GUEST must confirm arrival and departure times in advance. Rooms are available from 16:00 on the day of arrival; if the GUEST expects to arrive after 18:00, the PROVIDER must be told in good time. Check-out is at 11:00 in the morning on the day of departure unless otherwise agreed. A further day may be charged if these times are not met.
Agreed prices are binding on both parties. The PROVIDER may adjust a price after the agreement has been made only where taxes, supplier charges or other costs outside its control increase.
A security deposit of EUR 2,000 is payable before arrival. It is returned once the means of access have been handed back and the property and its contents have been checked for damage.
Where no damage is found, the deposit is returned within one to two weeks, allowing for administrative and banking procedures. Where damage is found, any balance is returned once the repairs are complete, and the time taken depends on the damage. The PROVIDER is not responsible for how long a repair or replacement takes.
Any bank charges or administrative costs arising on the return of the deposit are borne by the GUEST, together with an administrative charge of EUR 65 plus Value Added Tax where repairs have to be arranged.
The deposit is released only once the GUEST has provided a certificate of bank account ownership.
Under anti-money-laundering and counter-terrorist-financing rules, all payments must be made by bank transfer to the PROVIDER's account.
Additional services and expenses during the stay are invoiced at the end of the stay and must be paid within five working days of the invoice. Late payment accrues interest at the statutory rate plus three points.
All prices in this agreement and in the price list include Spanish Value Added Tax at the rate applicable to accommodation and related services. The PROVIDER issues an invoice for every payment and for any additional services, showing the taxable base and the Value Added Tax separately.
As an accommodation provider, the PROVIDER must keep a register of the travellers staying at the property and report the required details to the competent authorities. The GUEST must give the PROVIDER the identification details of everyone staying before arrival, and notify any change. This information is used only to meet that obligation.
The PROVIDER and the GUEST will each raise any matter affecting this agreement, its terms or the settlement of the stay as soon as it arises. Any special arrangement, and any significant change to the stay, must be agreed in writing.
Technical systems and appliances at the property — air conditioning, refrigeration and similar equipment — may occasionally need repair or stop working through normal wear and tear.
The GUEST is responsible for supervising their party while at the property. Noise must be kept at a level that does not disturb neighbours or the public. The maximum occupancy stated in this agreement may not be exceeded without the PROVIDER's written consent.
Drones may not be flown at the property. This agreement is not an authorisation to do so; flying a drone in Spain requires prior administrative authorisation and licensing.
Filming or photography for commercial purposes, or for distribution on social media or any other platform that makes content available to third parties, is not permitted.
The PROVIDER is not liable for damage or injury to the GUEST, their party or their property caused by the acts or neglect of the GUEST or their party. The GUEST will hold the PROVIDER harmless against any claim arising from those acts or that neglect.
If the property is left in an excessively dirty condition, or if the facilities or their contents are damaged or misused, the GUEST will compensate the PROVIDER. The amount depends on the damage and is deducted from the deposit. Where the cost exceeds the deposit, the PROVIDER will seek the balance from the GUEST.
Where an authority or the police imposes a fine or penalty relating to the GUEST, the GUEST pays it directly and within the period allowed, even if the notice is served on the PROVIDER.
The PROVIDER may identify to the authorities the individuals responsible for any breach of the law.
Access to the property and its doors is by mobile application. The GUEST should download it well before the stay and confirm that access has been granted. Instructions are set out in the user guide provided on site.
A physical key may be issued in exceptional cases. Where keys are issued, the GUEST returns the complete set to the person handling check-out. If they are not returned, EUR 10 for each key and EUR 45 for the main gate remote control are deducted from the deposit.
If keys are not returned by the check-out time on the day of departure, the GUEST pays the PROVIDER the daily rate for each day of delay.
The PROVIDER is not responsible for weather conditions or acts of nature occurring during the stay, and no refund is made on that account.
The GUEST is responsible for the safety of their party, including children, at the pool, on the terraces and elsewhere at the property. There is no lifeguard, and supervision is the GUEST's responsibility.
Monitored security cameras are installed for the protection of both parties. They cover the exterior and the common access points and are not active in the accommodation areas while the GUEST is on site.
If the GUEST intends to leave the property unoccupied for a longer period, the PROVIDER can activate the cameras at the GUEST's request. Signage is displayed at the property, the images are used only for security, and they are kept only for as long as the law allows.
Valuables should be taken with the GUEST when leaving the property, or kept in the rooms at the GUEST's own risk.
Decorations, posters, flags, signage and any special equipment must be agreed with the PROVIDER in advance. The GUEST keeps sound to the agreed level and observes the agreed finishing times for meetings, meals, music and dancing.
Electric vehicles, and any device not belonging to the property or with high electrical consumption, may not be charged without the PROVIDER's written consent and an agreement on payment. Where this happens without consent, the PROVIDER invoices the consumption it reasonably estimates to have been used.
Smoking is not permitted inside the buildings, and any breach is deducted from the security deposit. Narcotics may not be kept or used at the property.
The PROVIDER treats all personal data provided by the GUEST as confidential and uses it only to deliver the services under this agreement and to meet its legal obligations, in accordance with the EU General Data Protection Regulation, Organic Law 3/2018, Royal Decree 1720/2007 and other applicable data protection law.
The GUEST may not assign this agreement without the PROVIDER's written consent.
This agreement is governed by Spanish law.
The GUEST confirms having read this agreement in full and agrees to comply with it throughout the stay.
